The FDIC insures your deposit accounts up to 100,000 USD per depositor. They have no control over whether you open a letter properly. A lawsuit like this would most definitely be dismissed, if you can even find a lawyer to file on your behalf.

Assuming that you're able to stop the bleeding, pick up the phone right now and call a starving attorney. They'll sue anyone for anything.
