Since you don’t want to serve your guests meals at home, and you don’t want them to use your pool either, I’d say the best venue for the party (and the least stressful for you) would be a restaurant!.
Having the party in your home—even WITHOUT having to prepare full meals—will be a TON of work!. You will have all the cleaning ahead of time, then running out for ice, buying all the cups, plates, decorations, utensils, birthday cake, as well as preparing snacks and such!. DURING the party, you will be running around clearing empty glasses off of tables, refilling the chip bowls and snack platters, wiping up spills, etc!. Then AFTERWARDS, when you’re thoroughly exhausted, you will face all the clean-up, which will be considerable for that number of people!. And throughout it all, you will have the full-time care of your baby, the birthday boy!.
If you have it at a park, you have the hassle of toting EVERYTHING—snacks, drinks, ice, paper plates, plastic cups, utensils, decorations, chairs (and maybe even tables), and the all-important birthday cake--to the park (which is no small feat, as I’ve learned the hard way)!. You will also need to provide your guests with some form of entertainment to justify having it in the park, as well as plan for an alternate location in the event of rain!. It will end up being more of a hassle than a true celebration!.
Your son’s first birthday is a special occasion and you, as the mom, should be able to ENJOY the celebration along with your guests!. That’s why my vote is for a restaurant!.
Good luck, and have fun!

Unless money is no object for you, you can keep the restaurant costs down by having the party at a nice pizza parlor, preferably one where the proprietors are able to provide you with a private room big enough to accommodate 40 people!. (Most places like this allow you to bring a birthday cake for the occasion!.)
I do agree with Spooky that 40 people, only 4 of which are children, isn’t really a party for your son, who himself will have no recollection whatsoever of the party, regardless of the fashion and venue in which you give it!. You might want to re-examine your motives for giving such an extensive party (with 40 guests) in the first place!.
In any case, I wish you the best of luck and hope that your son’s 1st birthday party is a happy occasion for all involved!.Www@FoodAQ@Com

Go to a Park!. Less mess at home and you won't have to worry about the pool!.
Go for cake, Ice cream and cookies!. Make sure you take a high chair for your son!. Paper plates, paper bowls, plastic forks and spoons!. You can just throw it all away when your through!. Kids can play at the park while the grownups visit!.Www@FoodAQ@Com

40 guests (all family!? - wow) and only 4 are children!?, this is no party for your son!.
I would make his party on another day, with maybe just 6 other children!.
Have your huge adult party in the evening!? as you said not a pool party but with nibbles and a punch!.Www@FoodAQ@Com

40 guests only 4 kids!?
and skimping on everything!? you have a pool but don't want a pool party, etc!?
you might as well move it to chuckie cheese, where at least the kids can enjoy themselves!.Www@FoodAQ@Com

If your home can accomodate 40 people (backyard even, just don't use the pool!) that would probably make things easiest for you since you won't have to haul food and cake all over the place with a small child!. Otherwise, I would suggest renting a camp kitchen in a nice park, and make just portable snacks like cheese and crackers or spinach dips and things like that!. Bring some toys and games for kids and don't forget the cake!! Saves you from having to clean your house before and after and nobody will expect a full meal!. Of course you could always make it a bring your own meat or just a potluck picnic if the park has a bbq you can use!. Have fun!!Www@FoodAQ@Com
