It's both, but society is to blame for the confusion.
By strict botanical standards, a tomato is a fruit - namely a fleshy ovary-like plant part that contains seeds.
However, in terms of culinary terms, a number of fruits that are not sweet, and used in savory or salty dishes are considered vegetables by society. Eggplants and bell peppers are 2 other fruits that people cook as vegetables.
So, to scientists, it's a fruit, but to chefs it's a vegetable.

FYI ... in 1893 the US Supreme Court ruled the tomato was a "vegetable" and therefore subject to import taxes. The suit was brought on by a consortium of growers who wanted it declared a vegetable to protect U.S. crop development and prices. Fruits, at that time, were not subjected to import taxes and foreign countries could flood the market with lower priced produce. (A hundred years really hasn't changed anything.)

The big question to ask is DOES IT HAVE SEEDS?
If the answer is yes, then technically, you have a FRUIT.

I have always heard that a tomato is a fruit because of the seed thing. But then that would mean that cucumbers, bell peppers, squash, pumpkins, and several others would be considered fruit too. I say call it a vegetable for crying out loud!
