A tomatoe grows on a plant that isn't a bit woody - like a tree. So this is vegetable.
If it would grow on a tree-like thing, it would be fruit.

However, in the kitchen, it is mostly concidered fruit.

My, Ive seen this question a billion times!

My grandma told me this along time ago, its a fruit. Some people might call it a vegetable though because they don't know so other wise...
