Question: I broke my front tooth, about a third broke off!.!.!.should the restaurant be held responsible!?
a few days ago my husband, my mom and myself ate at a wonderful italian restaurant!. then we brought home some pastries!. we've had pastry from their bakery before, it's fantastic! today i was eating a piece of tiramisu and bit into a hard chunk of chocolate!. it broke a third of my front tooth off! tiramisu is a soft dessert there is no chunks of chocolate in this usually!. we've had their tiramisu before and there were no chocolate chunks it in before!. this sucks! my husband took a picture of the chocolate chunk and of my broken tooth!.Www@FoodAQ@Com

It probably wouldn't do you any good to sue!. There is a very small chance you would get anything more than compensation for the dentist bill and you would only be replacing that cost with expensive legal fees

Make sure that you get in contact with the manager (not just an angry waiter)!. If the manager is courteous and the cost to fix the tooth isn't too much, than just shrug it off and call it a bad day!.
*No matter what, be patient and kind with the manager!. If you do that you are much more likely to get what you want!.Www@FoodAQ@Com

Big Deal! So you broke a tooth!.!.!.get over it!. You brought the stuff home with you, so it didn't happen in the restaurant!. How can they be held liable for you breaking a tooth in your own home!? A couple photos of a chunk of chocolate and a broken tooth aren't evidence enough!. For all anybody knows, you may have broken it on the silver spoon you were born with in your mouth!. Its obviously their fault, if you bought the tiramasu from them, regardless of whether its MEANT to have chocolate in it it did and caused serious damage to you!. So yes they should be held responsible!.

Don't sue!. That is what is wrong with this country!.!.!.everyone is blaming everyone else for everything!. I own a restaurant and would be willing to pay, or help pay, a dental bill for someone in your situation, provided you did not tick me off by threatening to sue me!. if a chunk of chocolate broke your tooth, then your tooth was probably fractured from something else when you bought the pastry, and that hit the break just right!.

Your tooth was obviously fragile before you ate the dessert!. Chocolate doesn't break a "healthy" tooth!. I do understand that you feel upset that the lady was rude to you on the phone!. But I don't think you have a court case!. You'll know for sure if you have a case if you are able to retain a lawyer!. If it's really the restaurants fault, a lawyer will snap up your case for sure!. But I wouldn't get my hopes up on this one!. If you fell in the restaurant and broke your tooth, that would be a whole different circumstance!. Sweety, just don't depend on them having to fix your tooth, call a lawyer on Monday and find out for sure!. But get your tooth fixed, everybody will miss your beautiful smile!Www@FoodAQ@Com

If you've documented the break, and the piece of chocolate by taking photos, and you have witnesses (your family) I'd say you might have a case!. Talk to a lawyer!. Be sure to keep all your paperwork from your dentist!. He may even be able to tell you if that piece of chocolate could cause the damage you incurred!.
Of course the woman on the phone is going to deny any culpability!.By the way, I've eaten a LOT of tiramisu and made it myself, and it's always had grated chocolate in it!.Www@FoodAQ@Com

Well, first of all, the restaurant obviously made a mistake in their cooking of this tiramisu!. perhaps a chocolate chunk fell in while they were making it!. Second of all, unless this chocolate chunk was frozen, it is sort of impossible to break your tooth on, so make sure it was chocolate!. Mabey it was just the fork!. It is your choice wheater to sue them or not!. I would think about this though!. It it more expensive to fix my tooth at a dentists office, or to pay your lawyer, and all the other expenses that come in while suing someone!.Www@FoodAQ@Com
