Question: I like to brand my turkey burgers as "Gobblers"!. A Go DoNut store has used the word!. Can I still go ahead!?
The word is associated with turkeys but since the store has claimed it first and put it already in the mind of customers, maybe I should look for another!? Any bright suggestion is welcome!. Thanks!.Www@FoodAQ@Com

Not if they have a copywrite on it!. Ask them or the copywrite office!.
If they haven't!.!.!.go for it!.!.only apply for your own copywrite fast!.

BTW, where are you located!? There is a resturant in Gaylord, MI called Gobbler's that serves turkey dinners and 9 different kinds of burgers among other things!. Their motto is "Gobble till you Wobble"!.
If that's not you!.!.!.you'd better check them out as well for copywrites!.
If you Google "turkey, burgers, gobblers" you'll get a whole assortment of turkey burger recipes with the word Gobble in their names!. Might give you some ideas!.Www@FoodAQ@Com

If the name is trademarked then yes, look for another name!. Even if the other company doesn't mind you naming it, trademark law will guaranteeably force them to sue you to protect interest in their trademark!.

It's a consumable item, so it might be considered "confusing" at which point you wouldn't have a right to grab!.Www@FoodAQ@Com
