I've never heard of any law that says you can't spit in someones food!. It doesn't seem like the sort of thing that would be in the Crimes Act!. Or other legislation!. Always be nice to the waiter!. That's my rule!.
It's always better to pretend to be understanding, and always say thank you, then to get your food tampered with!.

At the end of the meal it's easy enough to bring the manager over and complain!.Www@FoodAQ@Com

Absolutely it is illegal!. You are talking about body fluids here and considering the Aids problem you could be charged with assault and put in jail!. May I suggest you quit your job as soon as possible!. You do not have the mentality to be a waiter/cook!. You have to be able to deal with people whom you may not like every day and still do your job in that line of work!. Obviously you can't handle it!.Www@FoodAQ@Com

It happened where I live early last year and the cook/spitter was arrested for fourth degree assault!. I'm not sure if there are other charges that a person can get for doing it!.

EDIT: After seeing LaLizzy's answer I found another article from New York about two people that did it and they were arrested for criminal tampering like she said so it sounds like the charges may vary by state!.

a death sentence and your off to jail better never to let no one see you do it nor ever get caught cause your jail bait for bubba in the showers
