Is a tomato a fruit or vegetable?!

Question: Is a tomato a fruit or vegetable?
My friends and i had this discussion.. and i cant decide!

Answers:

The tomato is a fruit that we typically use as a vegetable

Fruits have seeds or a pit inside and grow on a tree, a bush, a shrub or a vine

That outta get you thinking about all of the other "vegetables" that are botanically fruit!

It's a fruit.

It's the edible seed of a plant. It's the edible reproductive part of a plant. It contains seeds ( like human eggs). Usually they have flowers at the end of their body.
A vegetable is the edible root or tuber of a plant.

Here's the truth. finally.

While botanically, the tomato is a fruit, our illustrious FDA designated it as a vegetable (in the 1950's, I think) so we could tax the imported tomatoes at a higher rate.
