Traditional Absinthe is not legal in the U.S.. Absinthe isn't controlled as a drug but as a food product by the FDA. It is illegal to sell Alcoholic beverages that contain thujone that was banned as a food additive according to Section 801A of the Federal Food, Drug, and Cosmetic Act of August, 1972. Thujone is the active ingredient in wormwood used for making Absinthe and is considered psychoactive.

I live in Texas and it's not illegal here. I depends upon where you live and what the liqueur laws there are. You can buy it off line, but there are still restrictions upon where they will sell/ship to.

It is illegal to make and sell here. It is not illegal to have. You can go online, buy it and have it shipped to you. I just bought another few bottles last weekend. Mmmm...tasty!

Right now true Absinthe is not available in the US for its possible hallucinogenic effects, there are substitutes that are available in the US that are supposed to have the same taste but is not made with worm wood which is the ingredient in question in true absinthe.

At one point, it was. Today it isn't.

It's not entirely banned in America. It turns out that it's thujone that is banned (that's the component of grand wormwood that was said to cause hallucinations and such--in fact, if there were bad reactions to absinthe it was usually inferior absinthes colored with chemicals that caused these side effects.) Luckily, recent tests on "pre-ban" absinthe that somehow hasn't been drunk before now has revealed that there wasn't much thujone in absinthe 100 years ago after all.

Ted Breaux, a man who did a lot of that research and has developed some lovely absinthes that are available in Europe, recently released an absinthe called Lucid in the U.S. It's based on absinthe recipes from the drink's heydey and is available in some stores listed here: http://www.drinklucid.com/get_lucid_absi...

Yes. But in High Times they sell kits so that you can make it. I guess they can't sell it made in bottles but if you make it yourself than they can't do anything. I want to try some myself.
