Absinthe is generally accepted as illegal in the US (yes Virginia, Hawaii *is* a state) but that's becoming fuzzy considering the introduction of "Lucid" and that the makers state that the composition complies with US beverage requirements. It's made entirely with authentic absinthe ingredients (including Grande Wormwood or artemesia absinthium, which is indeed the source of the oh-so-mysterious thujone).
Lucid is only entering the US market in select locations but sooner or later it will make its way to LA.

The currently available substitute for absinthe in the US is not "absynthe" but Absente whose slogan is "absinthe refined."

Not yet. But it will be showing up on the shelves soon. It has already begun being stocked in some liquor stores in NYC.
Absinthe will be made available under the name Lucid imported from France by NY based company Viridian Spirits and sold for about $60 for a 750 ml bottle.
So no more prohibition on Absinthe, it is once again legal.

The FDA bans products that contain Grand Wormwood and thujone, and since most absinthes contain trace amounts of thujone they are banned. As mentioned a new product called 'Lucid' will be on the market soon in select areas (NYC being one of them) that lacks thujone making it legal to sell, however it will probably be awhile before it makes its way to LA or Hawaii.

Absinthe is STILL illegal in the states, they are now selling AbsYnthe, which containes no wormwood and is available at most large liquer stores..just ask them to order it for you.
It is NOT illegal to drink it, or have it in your home, so you can mail order on line from out of the country.
Some of the big name bars carry the real stuff under the counter in LA, but you have to be on a list to get in those clubs, and know someone who knows someone to actually get a drink of it..
