It can vary from state to state....here is an example from Alaska

The alcoholic beverage laws do not prohibit licensees or their agents or employees from drinking. However it is illegal for a drunken person to remain on licensed premises. So if a bartender became drunk the bartender could face criminal charges and the liquor license could be in jeopardy.

Yes it does vary from state to state.

But most states do not set a law against it.. normally its up to the restaurant to do that. I have worked in several rests and each one is a little different when it comes to that. Some strictly enforce it... and some dont care as long as you dont get drunk.
