My friend was in a bar in Dallas and was drinking straight from the pitcher when a cop rudely yanked him by the arm and told him he could have him arrested for drinking out of the pitcher. He made him put it in a glass.

I think either your friend's story is BS, or the cop is full of BS.

No, it is only illegal if you are in public or underage/a minor. Now, some bars may not like having their patrons drink from pitchers, so they might have their own policies in place to prohibit the act.
So, feel free to drink out of the pitcher the next time you are in the lone star state!
It isn't illegal, but some restaurants have policies that allow pitchers to be shared by two or more people. If you violate their policy, they can require you to leave.
Chapter 105 in the Alcoholic Beverage Code in Texas Law doesn't mention a type of open container. So this is certainly a law set forth by the establishment.

It is not against the law to drink from a pitcher although it is most likely against the rules in that particular bar
It's not illegal but it's rude. We don't allow strangers to salivate into our beers. Here in TX we drive the biggest trucks and we drink from the biggest glasses on Earth .
In NJ there are laws that limit the number of drinks a person can in front of him, including the upside down shot glasses, at one time. Pitchers must be shared because that would violate the amount of drinks a person has in front of him.

Sounds like the Cop was yanking his chain. Probably thought it was rude or just a stupid stunt.
He'd be MORE likely to wait until Your friend finished, then try to cite him for public intoxication, but one pitcher might not be enough for that...
If there IS a law on the books like that it's one of those local codes they haven't enforced in 60+ years since it's purpose is long past (like not sneezing in the street because it may startle the horses...)
