Whats the REAL legal age?!


Question: ok i just recently read a question of a kid [15] asking if it was legal for him to be drinking at home.

all the answers were, yes if ur 18.

so...
where im from you have to be 21 to purchase alcohol, and drink it at restraunts/clubs.
does that mean that i can legally drink it if im at home?

or does the person just live in an area where the age is 18?

In most states, there is a family exception to the consumption of alcohol by persons under 21. Some states put a minimum age, others don't and leave it up to parents. I believe in MA, it is legal at 16, but don't quote me on that one.

The basic idea is that if a parent wishes to give THEIR minor child an alcoholic drink in THEIR house, it is legally acceptable. This doesn't extend to minors at others houses, or other minors in the parent's household. This also does NOT extend to restaurants, clubs or bars.

It means you can legally drink at home WITH your parents. The idea is that you can't take a beer from the fridge, but they can hand you a beer from the fridge.

As to the Missouri thing up above, the law has always been and still is that only persons 21+ can purchase alcohol.
The law doesn't mention anything about parents or guardians or children emancipated from their parents. 21 means 21 here. In fact, if an 18 year old were to be emancipated from their parents, the only thing they could argue is that they are allowed to snag a beer from their friend's fridge, provided their friend does not mind and does not charge money.

you have to be the legal age in the area that you are drinking in... usa is 21 australia and uk is 18 and alot of places in europe like germany are 16..

there are different rules for different areas. In his area it sounds like you can buy at 18, and at younger ages you are aloud to drink in private as long as there is someone of age to be a sitter, or over view the situation

In my state, Missouri, it is legal for a parent/ guardian to provide alcohol to a minor. This has caused great contreversy though as 18 year olds are saying they are there own guardian and should be able to buy for themselves at 18
