I`m not saying he was a drunk-driver.. but would this be illegal? If you are allowed to light a cigarette and smoke it, then are you allowed to swig a bottle of lager?

Depends where you come from, i see people from the US are answering but if you are in the UK it`s not illegal unless you are over the limit. So if that was the first drink then he may not be. (Sounds like he was though)
However, if drinking or lighting a cig or turning the radio over or turning around to tell the kids off (basically anything that distracts you) causes an accident then you can be prosecuted for dangerous or careless driving.

In Australia it is illegal to have an open bottle of alcohol in the car.

this would definately be illegal because first of all he has an open container, and they would probably give him a breathalizer and find out he's drunk

no..u can have no open alchol drinks while driving in car..and if u do and get pulled over u better hope u put it in ur trunk and leave it shut till u get home and open it..thats considered a dui..or open consumption..cant spell but u kno where im getting with this........
