Question: Do licencees in Scotland have the power to refuse to sell alcohol to someone who is not underage or drunk!?
I think that supermarkets/off licences have the legal power to refuse to sell alcohol to anyone for whatever reason they wish - or for no reason!. My sister insists that they can't refuse to sell to someone who can prove that they are over 18 and are not drunk!. Any experts out there!? Help!Www@FoodAQ@Com

When you walk into a pub and ask for a drink and you are served and have paid for the drink, you have negotiated a contract with the licencee!. If the licencee for some reason does not wish to enter into a contract of sale, he/she is under no obligation to do so!. If you can prove that you have been unlawfully discriminated against, you should contact the police!.Www@FoodAQ@Com

Well in the U!.S a bartender has the right to refuse alcohol that appears to be intoxicated and the right to refuse the sale of alcohol to minors (Persons that are under the age of 21) and persons that appear underage will be asked for proper identification I was a bartender for 5 yearsWww@FoodAQ@Com

1!. Someone under the influence of alcohol or drugs!.

2!. A police officer in uniform!.

A shop-keeper has the right not to serve anyone - this doesn't just apply to alcohol - and they don't have to give a reason!.

I think the owner of the shop could as they have disclamers such as "We reserve the right to refuse service to anyone" but if it was tescos or summin i dont think the cashier can descide themselves!.Www@FoodAQ@Com
