yes without a doubt!. their going to the pub intending to drink and then drive therefor its premeditated they know they could kill someone if they are drink driving the familys of those who die suffer a lifetime so why shouldnt the driver !!Www@FoodAQ@Com

No as murder is usual defined as intentional killing,that you set out with the intention to take someones life,murder usually has a motive!.

Drunk drivers don't go out to deliberately kill anyone though this is often what they end up doing!.The fact that they are drunk means that there is a degree of diminuished responsibility even though they are to a large degree aware of what they're doing !!

Their should be a punishment that reflects the seriousness of their actions thou because at the moment it doesnt reflect the damage they cause !! Www@FoodAQ@Com

Not first degree murder, not if it wasn't premeditated!. I think manslaughter would be as far as it could go, if the drunk person didn't set out to kill someone on purpose!. I suppose, even if the drunk decided he wanted to kill someone, it could be argued that he had impaired judgment due to alcohol consumption, like a form of temporary insanity!. Www@FoodAQ@Com

Absolutely!! A car (or other vehicle) is essentially a lethal weapon!. Bearing this in mind, anyone who makes the decision to drink and drive has therefore done so knowing of the huge danger this poses!. It could be seen as premeditated which would make the death of any resultant accident, murder!.Www@FoodAQ@Com

Yes they should, and I am assuming you are referring to the case today of Luke McCormick who got 7 years for killing the 2 boys in the car crash after being drunk in charge & falling asleep and causing accident!.

It does not matter a bit as some people have posted here regarding whether it was premeditated or not the 2 boys are still dead -- regardless of whether he meant to or not!.

If you kill some one with a gun,you get tryed as Murder if you kill some one,right!?same as you get behind the wheel drunk!
I was in one of thos drunk driving accident,thank God i hit no one!.
But you know what!?I made that choice too drink and drive before i took that first drink!.Why!?Because i did not make a plan too have some one too drive me home!.I new what it would do!.
Thank God Deliverd me from drinking!.

If you are in the UK, then I'd definitely advocate in favour of a "second degree" level of murder!. In effect causing death (unintentionally) by action or omission of action contrary to the Road Traffic Act!.Www@FoodAQ@Com

yes I do!. People who drink and drive are stupid, this is not a new practice among drinkers, anyone stupid enough to do it deserves to be punished to the fullest extent of the law!.Www@FoodAQ@Com
