A minor commits and offense if he consumes an alcoholic beverage. However it is an affirmative defense to prosecution under this section that the alcoholic beverage was consumed in the visible prescence of the minors Adult parent, guardian or spouse.

This basically means that you can still be chraged, however, its unlikely.

No it is illegal period

Regardless of who buys the drink, you cannot legally drink alcohol under the age of 21 anywhere in the US to the best of my knowledge. If you were in your home and it was kept private, that would be one thing (although still technically illegal), but out in public, more than a sip and you could be in for it.
