Here's what Wiki has to say...:

" A faux-absinthe liquor called Absente, made with southern wormwood (Artemisia abrotanum) instead of regular wormwood (Artemisia absinthium), is sold legally in the United States and does not contain thujone.

In 2007, Viridian Spirits LLC released Lucid, an authentic absinthe made using Grand Wormwood, in the US. Lucid is reported to have a low enough Thujone content to pass US regulatory reqiurements.[39]"

So, as you can see in that last line, there are brands you can purchase but the wormwood level has to be low enough...After all, how do Manson, Dita, and Depp drink it.

You should read the section on wiki...it has some good facts if you want to import it for personal use. I know that you can NOT have it in retail.

PS. Make sure to have all things needed: An Absinthe glass, an absinthe spoon, some sugar cubes, and possibly a lighter depending on seving method. I love the stuff....Zürcher Fee is my favorite. Make sure to check up serving instructions. I add milk to mine as well.

Technically, yes. US customs lists it as a prohibited item.

No...I do it all the time.

You can do that, but please be careful not to choose a crappy fake absinth from the Czhech Republic (low grade alcohol artificially coloured who usually mentions absinth's fake "hallucinogenic properties"), choose either a french or preferably swiss brand, they're the ones making real distilled absinthe.
And don't forget, never burn sugar into it, drink it dilluted in ice cold water and please don't think it's hallucinogenic, it's not, never was, never will be.
